What is Class 041?

Class 41 covers a lot of bases within Education and Entertainment. The description of services includes Education, Entertainment, providing of training, and sporting and cultural activities. Note that there are subcategories to each of these fields.

Below, we’ve listed an overview of what business services Service Class 041 covers, with a few examples of activities that fall under each type.

Of course, dozens of other activities fall under this category–these are just a few to help you better understand the categorization and whether your services and offerings are applicable. You can see that truly any art form, educational service, literature piece, sporting or cultural activity, or training program falls under this category, no matter how loosely. This class is pretty straightforward compared with other class types. 

Who does it apply to?

As stated above, Class 41 is a service-oriented trademark and is included in nearly 10 percent of all trademark applications. When registering Service Class 041, you must provide more than just the trademark class identifier. Much like other classes, you’ll need to deliver specimens associated with the class that is evident in your services offered. You’ll need to submit something physical or digital that demonstrates your trademark being used concerning the service you provide or plan to provide. 

Some examples of what this could look like include

  • Website displaying what you offer (service)
  • Magazine or newspaper ads
  • Brochures
  • Billboards
  • Flyers

If you plan to offer classes, training, or an entertainment service in the future, you should likely trademark class 41. Just be wary that you can really only file in classes where you’ve already had commercial use or have a bona fide intent to use said service–with mentioned examples or services offered. 

Remember that you’ll likely need to apply for related classes that cover goods if you offer or plan to offer products with your Education or entertainment service. Say, for example, you plan to eventually create clothing related to your DJ services or toys relevant to your education service–you’ll want to include the relative classes in addition to Class 41.
